Terms of Use

These Terms govern your use of MyFriendlyWallet — a non-custodial stablecoin wallet — and the MFW Developer API. Read them carefully before using the Services.

Important — read before using MyFriendlyWallet is non-custodial software. We never hold, control, or have access to your assets. Blockchain transactions are irreversible. You are solely responsible for the security of your keys and PIN.
Section 1

About & Agreement

These Terms of Use ("Terms") are a legally binding agreement between you ("you" or "User") and Crypteria AS, a Norwegian limited liability company ("MFW," "we," "us," or "our"). They govern your use of the MyFriendlyWallet application, website, developer API, and all related features (collectively, the "Services").

By accessing or using the Services you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Services.

We may update these Terms from time to time. Material changes will be communicated through the App or by email with reasonable advance notice. Continued use of the Services after any update constitutes acceptance of the revised Terms.

Non-custodial status

We never hold your assets MyFriendlyWallet is purely non-custodial, self-custodial software. We do not ever have custody, possession, or control of your digital assets at any time. We cannot freeze, reverse, or modify any transaction.

We are a software developer and provider. We are not a bank, custodian, exchange, broker, money transmitter, payment service provider, or crypto-asset service provider (CASP). Your private keys and PIN are known only to you — we have no way to access or recover them.

Eligibility

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) and have full legal capacity to enter a binding agreement. You must not be subject to economic sanctions or be on any list of prohibited parties maintained by the UN, EU, US, UK, or any other relevant governmental authority.

Section 2

The Services

Wallet & @usernames

The App lets you generate and manage self-custodial blockchain wallets, view balances, compose and sign transactions, and send or receive supported digital assets. MFW @codes (such as @SARAH) are human-readable aliases that resolve to your wallet address as a convenience.

MFW usernames are provided on a best-effort basis. We reserve the right to reclaim or deactivate any username for abuse, impersonation, inactivity, or trademark reasons. You may not sell or transfer your username to any third party.

Gas Relay Service

For certain networks we may sponsor blockchain transaction fees ("gas fees") through a gas relay. This is a technical infrastructure service — not a financial service. You compose and cryptographically sign all transactions with your own key; the relay only broadcasts your pre-signed transaction to the network. The relay never has access to or control over your assets.

We may modify, suspend, or discontinue the gas relay service, or change the Gas Relay Fee, at any time.

Stablecoins & Third-Party Assets

The Services support stablecoins including USDC, EURC, and USDT, which are issued by third-party entities independent of MFW. Stablecoins are not legal tender and are not issued, guaranteed, or backed by MFW. We make no representations about the solvency, reserve adequacy, regulatory compliance, or peg stability of any stablecoin issuer.

Digital assets in your wallet are not deposit accounts and are not insured by any government deposit guarantee scheme.

Section 3

Your Responsibilities

Security of your wallet

You are solely responsible for the security of your private keys, PIN, and recovery phrase. Key points:

  • We cannot recover your PIN, keys, or recovery phrase. If lost, access to your wallet and all assets therein is permanently gone.
  • Anyone who obtains your credentials can irreversibly spend your assets.
  • Keep a secure offline backup of your recovery phrase. Never store it digitally.
  • We will never ask you for your PIN, keys, or recovery phrase.
  • You are responsible for all activity through your wallet, whether or not authorized by you.
Recovery phrase — your obligation and permanent loss risk

Failure to safely store your recovery phrase will result in permanent, irrecoverable loss of all assets in that wallet. There are no exceptions.

When you generate a self-custody wallet in MFW, you are shown a recovery phrase (also called a seed phrase or mnemonic) consisting of 12 or 24 words. This recovery phrase is the only means of recovering your wallet and the assets it holds.

By using the Services, you explicitly acknowledge and agree to the following obligations:

  • You must write down your recovery phrase — word for word, in the exact order shown — at the time it is displayed. You must not skip or defer this step.
  • You must store your written copy safely and securely — in one or more physical, offline locations (e.g. a fireproof safe, secure document storage). Multiple copies in separate locations are strongly recommended.
  • You must never store your recovery phrase digitally — including in photos, screenshots, cloud storage, email, note-taking apps, messaging apps, password managers, or any internet-connected medium.
  • You must never share your recovery phrase with any person, website, application, or support agent — including anyone purporting to represent MFW or Crypteria AS. We will never ask for it.
  • If your recovery phrase is lost, stolen, destroyed, forgotten, or otherwise becomes unavailable, access to your wallet and every digital asset it holds is permanently and completely gone. No person, company, court order, or technical procedure — including MFW — can recover it. This outcome is absolute and irreversible.
  • If your recovery phrase is exposed to any unauthorised person, all assets in the wallet should be considered at immediate risk of theft. You must transfer assets to a new, secure wallet immediately.

You understand that this risk is an inherent and fundamental property of self-custody blockchain technology, and that you are accepting this risk knowingly and voluntarily as a condition of using the Services. MFW bears no responsibility or liability whatsoever for any loss of assets arising from your failure to comply with these obligations.

Best practice Write your recovery phrase on paper immediately. Store it in two separate secure physical locations. Never photograph or type it anywhere.
Transaction responsibility

Transactions are irreversible All blockchain transactions you initiate are final, irreversible, and non-refundable. We cannot cancel, reverse, or recover any transaction once broadcast to the network.

Always verify the recipient address, amount, network, and asset type before confirming. You are solely responsible for any loss from sending to an incorrect address or incompatible network.

Prohibited uses

You must not use the Services to:

  • Violate any applicable law, regulation, or rights of any third party
  • Engage in, facilitate, or promote money laundering, terrorist financing, sanctions evasion, tax evasion, or any other financial crime
  • Process proceeds of criminal or fraudulent activity
  • Distribute viruses, malware, or other harmful code
  • Interfere with, disrupt, or overload the Services or connected systems
  • Reverse engineer, decompile, or create derivative works of the Services, except as permitted by applicable law
  • Circumvent any access controls, rate limiting, or security measures
  • Engage in market manipulation, wash trading, or any deceptive trading practice
  • Impersonate any person or entity, or misrepresent your affiliation
  • Use the Services in any way that could damage, disable, or impair them
Section 4

Developer & Partner API

This section applies if you access the MFW API, integrate MFW functionality into your application, or participate in the MFW partner program ("Developer" or "Partner"). These terms supplement all other provisions in this document.

API Credentials & Security

Upon approval, we may issue you an API key prefixed mfw_. You are solely responsible for keeping your API credentials confidential and secure. You must not share, publish, or transfer your API key. You are responsible for all activity using your credentials and must notify us immediately if they are compromised.

The MFW API provides:

  • GET /v1/resolve/@code — public username resolver, no auth required
  • GET /v1/verify/@code — public existence check, no auth required
  • POST /v1/partner/send — execute sends on behalf of authenticated end users (requires both your API key AND the end user's active session token and PIN)
  • POST /v1/partner/request — generate payment request links and QR codes
  • GET /v1/partner/balance — read authenticated user's wallet addresses

Two-factor security model Your API key alone cannot move funds. Every send requires both your partner key AND the end user's active session token and PIN. A compromised API key without user consent is harmless to user assets.
Partner Fees

You may charge an additional Partner Fee on transactions processed through the partner send endpoint, subject to a maximum of 2% of the transaction value. This is applied on top of MFW's 0.15% Gas Relay Fee.

You must clearly and prominently disclose all Partner Fees to your end users before they authorize any transaction. Partner Fees must be shown separately from MFW's Gas Relay Fee. You are solely responsible for Partner Fee calculation, disclosure, and collection.

End User Protection

As a Developer or Partner you agree that:

  • You must not represent to end users that you hold custody of, or control, their digital assets or credentials
  • All transactions require the end user's own cryptographic authorization — you must never store, intercept, or misuse user PINs, keys, or recovery phrases
  • You must not configure your integration to divert or redirect user assets
  • You must maintain your own terms of service and disclose all applicable fees
  • You are solely responsible for customer support, dispute resolution, and legal compliance for your application
  • You will defend, indemnify, and hold MFW harmless from any claims arising from your application, your end users, or your Partner Fees

We may suspend or terminate API access at any time, with or without cause, upon notice to you.

Section 5

Intellectual Property

We and our licensors retain all rights in and to the Services, including all software, content, trademarks, and related intellectual property. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purposes. This license does not permit you to modify, resell, sublicense, or create derivative works of the Services, or to use our trademarks without prior written consent.

If you provide feedback or suggestions about the Services, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback without any obligation to you.

Section 6

Disclaimers

The Services are provided on an "as is" and "as available" basis without any warranty, express, implied, or statutory. We disclaim all warranties including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Blockchain & Digital Asset Risks

You acknowledge and accept the following risks:

(A) BLOCKCHAIN TRANSACTIONS ARE IRREVERSIBLE — WE CANNOT CANCEL, REVERSE, OR REFUND ANY TRANSACTION.

(B) STABLECOIN VALUES MAY FLUCTUATE OR LOSE THEIR PEG, POTENTIALLY RESULTING IN LOSS OF VALUE.

(C) BLOCKCHAIN PROTOCOLS MAY CHANGE, FORK, OR FAIL IN WAYS THAT AFFECT ACCESS TO YOUR ASSETS.

(D) SMART CONTRACTS MAY CONTAIN VULNERABILITIES THAT RESULT IN LOSS OF ASSETS.

(E) YOU ARE RESPONSIBLE FOR PROTECTING YOURSELF FROM SCAMS, PHISHING, AND SOCIAL ENGINEERING ATTACKS.

(F) REGULATORY FRAMEWORKS FOR DIGITAL ASSETS VARY BY JURISDICTION AND MAY CHANGE.

Nothing in the Services constitutes financial, investment, tax, or legal advice. We have no fiduciary duty to you. Consult qualified professionals before making decisions about digital assets.

Section 7

Limitation of Liability

To the maximum extent permitted by applicable law, MFW and Crypteria AS shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, revenue, data, or digital assets — regardless of the legal theory and even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of: (a) the total fees you paid to MFW in the twelve months preceding the claim; or (b) USD $100 (or equivalent in local currency).

Nothing in these Terms excludes or limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Section 8

Indemnification

You agree to defend, indemnify, and hold harmless Crypteria AS, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your access to or use of the Services
  • Your digital assets or transactions
  • Any dispute between you and any third party
  • Your violation of these Terms or applicable law
  • Your application, end users, or Partner Fees (if you are a Developer or Partner)
Section 9

Governing Law & Dispute Resolution

These Terms are governed by the substantive laws of Switzerland, excluding conflict-of-laws rules. Consumers habitually resident in the European Economic Area retain the protections of mandatory consumer protection law in their country of residence, which prevail to the extent of any inconsistency.

Arbitration

Any dispute arising out of or in connection with these Terms shall be finally resolved by arbitration administered by the Swiss Arbitration Centre under the Swiss Rules of International Arbitration, with a sole arbitrator in Zürich, Switzerland, in English.

You and MFW each waive the right to participate in any class action or collective proceeding. All disputes must be brought individually.

You may opt out of arbitration by sending written notice to support@myfriendlywallet.io within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the courts of Zürich, Switzerland, unless mandatory law in your jurisdiction requires otherwise.

Regulatory Notices

Non-custodial wallet — not a regulated financial service Providing non-custodial wallet software, where the provider does not have access to or control over users' private keys or assets, does not constitute a crypto-asset service requiring authorization under EU Regulation 2023/1114 (MiCA) or equivalent frameworks.

MyFriendlyWallet is software that enables you to self-manage your own digital assets. We are not registered with, or authorized by, any financial regulatory authority as a CASP, money transmitter, payment institution, or equivalent.

Stablecoins accessible through the Services (USDC, EURC, USDT, and others) are issued by third parties. Regulatory compliance obligations for those tokens rest with their respective issuers. We make no representation that any stablecoin is compliant with the laws of any jurisdiction.

You are solely responsible for determining your own regulatory and tax obligations arising from your use of the Services in your jurisdiction.

Section 11

General Provisions

  • Entire agreement. These Terms, together with any supplemental terms referenced herein, constitute the entire agreement between you and MFW regarding the Services.
  • Severability. If any provision is found invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions continue in full force.
  • Waiver. Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger or acquisition.
  • Force majeure. We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, cyberattacks, blockchain outages, or government actions.
  • Independent contractors. You and MFW are independent parties. No agency, partnership, or employment relationship is created by these Terms.
  • Language. These Terms are in English. If translated, the English version prevails.
